Who knows what happened to the driver.
If ever pulled over for DUI and you are impaired, when the cop asks you about doing tests and a breathalyzer/blood work - keep repeating to the cop that you want to first talk to a lawyer. More than likely, the case will be dismissed.
However, you will still end up with a 1-year suspension on your license for refusing (not taking) the breathalyzer/blood test.
This scenario actually happened to a family member. He moved out of state and got a new license in the new state; however, his driving rights were still suspended for 1 year in the incident state.
